For many parents, custody mediation feels intimidating. They imagine a courtroom setting, lawyers arguing, or pressure to agree to something they don't want.
But in North Carolina, custody mediation is completely different -- and it exists to keep families out of court.
Camino Law guides parents through this process every day, and here is what we want families to know.
1. Mediation Happens Without Attorneys
This surprises most parents.
The session is led by a court-trained mediator, and attorneys are not allowed in the room.
This is intentional. The process is designed to:
-
Reduce conflict
-
Keep cost low
-
Encourage cooperation rather than blame
2. You Will Have Already Completed a Parenting Class
Before mediation, parents must complete a brief online class. Most clients find it surprisingly helpful.
It covers:
-
Child development
-
Communication during conflict
-
How to avoid harming children emotionally
3. Mediation Isn't a Trial -- It's a Conversation
Parents meet with the mediator to discuss:
-
Schedules
-
Holidays
-
Transportation
-
School choices
-
Communication
You do not need to have everything figured out. The mediator helps you talk through it.
4. If You Reach an Agreement, You're Almost Done
When parents agree:
-
The mediator writes the Parenting Agreement
-
Parents take about 30 days to review it
-
A Judge signs it outside of court
-
The order arrives by mail
This is how 90% of custody cases resolve.
5. If You Don't Reach an Agreement, You Still Have Options
The mediator simply notifies the trial court that the case may need a hearing. But parents still have unlimited opportunities to settle. Many judges encourage one last hallway conversation before trial begins.
Why Camino Law Supports Mediation
Families spend far too much money -- sometimes tens of thousands -- on issues that could have been resolved with better information and a supported conversation.
Camino Law helps parents prepare emotionally and strategically so they can walk into mediation confident and ready.
