What Every Parent Should Know Before Their First Custody Mediation in North Carolina

For many parents, custody mediation feels intimidating. They imagine a courtroom setting, lawyers arguing, or pressure to agree to something they don't want.

But in North Carolina, custody mediation is completely different -- and it exists to keep families out of court.

1. Mediation Happens Without Attorneys

This surprises most parents.

The session is led by a court-trained mediator, and attorneys are not allowed in the room.

This is intentional. The process is designed to:

2. You Will Have Already Completed a Parenting Class

Before mediation, parents must complete a brief online class. Most clients find it surprisingly helpful.

3. Mediation Isn't a Trial -- It's a Conversation

Parents meet with the mediator to discuss:

  • Schedules

4. If You Reach an Agreement, You're Almost Done

When parents agree:

  • The mediator writes the Parenting Agreement

  • Parents take about 30 days to review it

  • A Judge signs it outside of court

  • The order arrives by mail

This is how 90% of custody cases resolve.

5. If You Don't Reach an Agreement, You Still Have Options

The mediator simply notifies the trial court that the case may need a hearing. But parents still have unlimited opportunities to settle. Many judges encourage one last hallway conversation before trial begins.
